Nothing in these Terms requires MiniTruckin’ to monitor user activity or remove any content, and our decision not to take action in a particular instance does not waive our right to enforce these Terms in the future.
Purchases, Orders, and Merchandise
MiniTruckin’ and its Affiliates, Partners, and Authorized Distributors may offer merchandise, subscriptions, event registrations, publications, promotional items, digital products, and other goods or services (collectively, “Merchandise”) through the Site or Services.
All purchases are subject to product availability, acceptance of your Order, and these Terms.
Pricing
All prices are listed in U.S. Dollars unless otherwise stated.
Prices, product descriptions, availability, promotions, discounts, and specifications are subject to change at any time without prior notice. MiniTruckin’ reserves the right to correct pricing errors, typographical errors, or inaccuracies, including after an Order has been submitted.
Applicable taxes, shipping charges, duties, customs fees, brokerage fees, handling charges, or other governmental assessments are not included unless expressly stated during checkout.
Acceptance of Orders
Submission of an Order does not constitute acceptance of that Order.
MiniTruckin’ reserves the right to:
- refuse or cancel any Order;
- limit quantities purchased;
- discontinue products without notice;
- require additional verification before accepting an Order;
- refuse Orders that appear fraudulent or unauthorized; or
- cancel Orders due to pricing errors, inventory shortages, supplier issues, suspected fraud, or other circumstances beyond our reasonable control.
If payment has already been collected for a canceled Order, we will issue a refund of the amount paid for the canceled Merchandise, unless otherwise permitted by applicable law.
Merchandise Sold Through Affiliates or Partners
Certain Merchandise available through the Site may be offered, fulfilled, manufactured, distributed, or shipped by an Affiliate, Partner, Authorized Distributor, or third-party fulfillment provider.
In those circumstances:
- additional terms or policies may apply;
- shipping times may vary;
- returns or exchanges may be handled by the applicable seller or fulfillment provider;
- warranties, if any, are provided only by the applicable manufacturer or seller unless expressly stated otherwise; and
- MiniTruckin’ is not responsible for the actions, omissions, or policies of third-party sellers except to the extent required by applicable law.
Payment
By submitting an Order, you represent and warrant that:
- you are authorized to use the payment method provided;
- all payment information is accurate and complete; and
- you authorize MiniTruckin’ and its payment processors to charge the total amount due, including applicable taxes, shipping charges, and other authorized fees.
Payments are processed through third-party payment processors, including Shopify and its authorized payment providers. MiniTruckin’ does not generally receive or store complete payment card information.
Order Confirmation
After placing an Order, you may receive an order confirmation by email. Receipt of an order confirmation does not constitute acceptance of your Order. Acceptance occurs only when your Order has been approved and processed for fulfillment.
All Merchandise is sold “as is” except to the extent a manufacturer’s warranty or other written warranty is expressly provided.
Product Availability
Product availability displayed on the Site is an estimate only and is not guaranteed.
MiniTruckin’ reserves the right to discontinue products, substitute comparable products where appropriate, limit quantities, or cancel Orders if inventory becomes unavailable.
No Resale
Unless expressly authorized in writing by MiniTruckin’, Merchandise purchased through the Site is intended for personal or internal business use only and may not be resold, redistributed, or offered for commercial resale.
Shipping and Delivery
MiniTruckin’, its Affiliates, Partners, Authorized Distributors, printers, fulfillment providers, and shipping carriers work together to process and deliver Merchandise, magazine subscriptions, and other Orders. Depending on the product purchased, your Order may be fulfilled and shipped by MiniTruckin’ or by one or more third-party fulfillment providers acting on our behalf.
Estimated shipping and delivery dates are provided for convenience only and are estimates, not guarantees. Delivery times may vary based on product availability, production schedules, carrier performance, customs processing, weather conditions, labor disruptions, governmental actions, and other circumstances beyond our reasonable control.
Customer Shipping Information
You are solely responsible for providing complete, accurate, and deliverable shipping and contact information when placing an Order. This includes, without limitation, the recipient’s name, street address, apartment or unit number, city, state or province, postal or ZIP code, country, telephone number, and any other information necessary to complete delivery.
MiniTruckin’ is not responsible for delays, failed deliveries, lost shipments, returned packages, additional shipping charges, or other losses resulting from inaccurate, incomplete, outdated, or incorrect shipping information provided by you.
If you discover that you have entered incorrect shipping information, you must contact MiniTruckin’ as soon as possible. While we will make reasonable efforts to update your Order before shipment, we cannot guarantee that changes can be made after an Order has been submitted or processed.
If an Order has already entered production or has been transferred to a printer, fulfillment provider, distributor, or shipping carrier, address changes may no longer be possible and additional fees may apply.
If an Order is returned because of an incorrect or incomplete address, refusal of delivery, failure to claim the shipment, or any other circumstance attributable to the customer, MiniTruckin’ reserves the right to charge additional shipping and handling fees before reshipping the Order or, where permitted by applicable law, deduct those costs from any refund otherwise due.
Risk of Loss
Except where otherwise required by applicable law, risk of loss and title to physical Merchandise pass to you upon delivery of the Order to the applicable shipping carrier or fulfillment provider for shipment.
MiniTruckin’ is not responsible for delays, interruptions, or failures in delivery caused by shipping carriers, postal authorities, customs agencies, printers, fulfillment providers, or other third parties involved in the production or transportation of your Order.
Damaged, Lost, or Missing Shipments
Although MiniTruckin’ and its fulfillment partners take reasonable care in preparing Orders for shipment, we cannot guarantee that packages will not be damaged, delayed, lost, or mishandled during transportation.
If your Order arrives damaged, you must notify MiniTruckin’ within seven (7) calendar days of delivery and retain the original packaging, shipping materials, and damaged Merchandise. We may request photographs or other documentation necessary to investigate the issue or assist in filing a claim with the applicable fulfillment provider or shipping carrier.
If a package is lost in transit, MiniTruckin’ may, at its discretion, assist you in communicating with the fulfillment provider or shipping carrier. However, MiniTruckin’ is not responsible for losses caused by shipping carriers, postal authorities, customs agencies, or other third parties once an Order has been transferred for shipment, except where otherwise required by applicable law.
MiniTruckin’ reserves the right to determine, in its reasonable discretion and subject to applicable law, whether a replacement, repair, store credit, refund, or other resolution is appropriate based on the circumstances of the claim.
MiniTruckin’ is not responsible for damage occurring after delivery, including damage resulting from improper handling, storage, misuse, accidents, environmental conditions, or normal wear and tear.
Nothing in this section limits any non-waivable rights or remedies available under applicable consumer protection laws.
International Orders, Customs, Duties, and Import Restrictions
MiniTruckin’ welcomes Orders from customers outside the United States. However, international shipments are subject to the laws, regulations, customs procedures, and import requirements of the destination country.
The customer is solely responsible for:
- determining whether ordered Merchandise may be legally imported into the destination country;
- complying with all applicable import, export, customs, sanctions, and trade laws;
- obtaining any licenses, permits, or governmental approvals required for import;
- payment of all customs duties, tariffs, import taxes, value-added taxes (VAT), goods and services taxes (GST), brokerage fees, customs clearance fees, storage fees, inspection fees, and any other governmental or carrier-imposed charges;
- any currency conversion fees or charges imposed by financial institutions or payment providers;
- any additional costs arising from customs delays, inspections, or governmental actions; and
- ensuring that all shipping and recipient information provided for an International Order is complete, accurate, and sufficient to permit customs clearance and delivery.
MiniTruckin’ has no control over customs authorities, import regulations, or governmental decisions regarding international shipments and makes no representations regarding the amount of customs duties, taxes, or other import-related charges that may apply.
If an international shipment is delayed, held, refused, abandoned, seized, destroyed, or returned by customs authorities, a shipping carrier, or the recipient, MiniTruckin’ shall not be responsible for any resulting losses, delays, governmental charges, storage fees, customs assessments, return shipping costs, disposal fees, or other expenses.
If an international shipment is returned to MiniTruckin’ because it was refused by the recipient, not claimed, determined to be non-importable, or otherwise rejected by customs or the shipping carrier, MiniTruckin’ may, in its reasonable discretion and subject to applicable law:
- reship the Merchandise after payment of all additional shipping and related costs;
- deduct all shipping charges, customs fees, carrier fees, storage charges, return shipping costs, and other expenses from any refund otherwise due; or
- decline to issue a refund where the Merchandise cannot reasonably be recovered, has been abandoned, destroyed, or otherwise rendered unavailable.
Original shipping charges, customs duties, taxes, brokerage fees, and similar governmental or carrier-imposed charges are generally non-refundable.
MiniTruckin’ is not responsible for delays caused by customs processing, import inspections, international transportation disruptions, governmental actions, or circumstances beyond our reasonable control.
By placing an International Order, you acknowledge that you have reviewed and accepted these responsibilities and understand that international shipments may be subject to additional costs, delays, and import requirements beyond the control of MiniTruckin’. MiniTruckin’ is under no obligation to reimburse customers for customs duties, taxes, brokerage fees, storage charges, currency conversion fees, or other governmental or carrier-imposed charges incurred in connection with an International Order unless otherwise required by applicable law.
Returns, Exchanges, Refunds, Order Cancellations, and Chargebacks
MiniTruckin’, its Affiliates, Partners, Authorized Distributors, and fulfillment providers strive to provide quality products and customer service. Because the products and Services offered through the Site vary, different return, cancellation, exchange, and refund policies may apply depending on the item purchased.
Order Cancellations
Orders may only be canceled before they have entered production, processing, fulfillment, or shipment.
Once an Order has entered production, has been submitted to a printer or fulfillment provider, or has been shipped, it generally may not be canceled except as required by applicable law.
MiniTruckin’ reserves the right to cancel any Order for reasons including, but not limited to:
- pricing or typographical errors;
- inventory shortages;
- suspected fraud or unauthorized activity;
- inability to process payment;
- supplier or fulfillment issues; or
- other circumstances beyond our reasonable control.
If we cancel an Order after payment has been received, we will issue an appropriate refund of the amount paid for the canceled Order, unless otherwise permitted by applicable law.
Merchandise Returns and Exchanges
Unless otherwise stated at the time of purchase, eligible Merchandise may be returned or exchanged within 30 days after delivery.
To qualify for a return or exchange, Merchandise must generally:
- be unused and in substantially the same condition in which it was received;
- include all original packaging, tags, accessories, and documentation where applicable;
- not show signs of wear, alteration, damage, misuse, or abuse; and
- be accompanied by proof of purchase or other information sufficient to identify the Order.
Certain products may not be eligible for return or exchange, including:
- customized or personalized products;
- digital products or downloadable content;
- gift cards;
- clearance or final sale items;
- opened or used products where resale is not reasonably possible; and
- any other products identified as non-returnable at the time of purchase.
MiniTruckin’ reserves the right to inspect returned Merchandise before approving any refund or exchange.
Magazine Subscriptions and Publications
Individual magazine purchases are generally non-refundable once shipped.
Subscription cancellations, renewals, refunds, replacement issues, and delivery claims may be subject to separate subscription terms, customer service policies, or subscription policies published by MiniTruckin’.
If a magazine issue arrives damaged or is not received due to a fulfillment or mailing error, MiniTruckin’ may, in its reasonable discretion, provide a replacement copy, extend the subscription, issue store credit, or provide another appropriate remedy, subject to product availability and applicable law.
International Returns
Customers are responsible for all costs associated with returning International Orders unless otherwise required by applicable law.
Original shipping charges, customs duties, import taxes, value-added taxes (VAT), goods and services taxes (GST), brokerage fees, customs clearance fees, carrier charges, and similar governmental or third-party fees are generally non-refundable.
Returned Merchandise remains the customer’s responsibility until received by the applicable return destination. MiniTruckin’ recommends using a shipping method that provides tracking and appropriate insurance.
If an international shipment is refused, abandoned, or returned because the customer failed to comply with applicable import requirements or customs procedures, MiniTruckin’ may deduct any resulting costs, including return shipping, customs assessments, storage fees, brokerage charges, or other expenses from any refund otherwise due, where permitted by applicable law.
Refunds
Approved refunds will generally be issued to the original payment method used for the purchase unless otherwise agreed.
Shipping charges, expedited shipping fees, customs duties, taxes, brokerage fees, and other third-party charges are generally non-refundable unless required by applicable law.
Refund processing times may vary depending on the payment processor or financial institution.
Chargebacks
If you believe there is an issue with an Order, we encourage you to contact MiniTruckin’ before initiating a chargeback or payment dispute with your credit card issuer, payment processor, or financial institution.
Initiating a chargeback does not relieve you of your obligations under these Terms.
MiniTruckin’ reserves the right to dispute chargebacks that we believe are fraudulent, abusive, or inconsistent with these Terms and to provide relevant transaction records, shipping confirmations, communications, or other documentation to the applicable payment processor or financial institution.
Where permitted by applicable law, repeated or fraudulent chargebacks may result in cancellation of Orders, suspension of accounts, refusal of future transactions, or other appropriate action.
Magazine Subscriptions
MiniTruckin’ offers print magazine subscriptions, digital subscriptions, and other subscription-based products or services. Subscription availability, pricing, duration, and benefits are subject to change at any time.
Subscription Fulfillment
Magazine subscriptions may be produced, printed, mailed, or otherwise fulfilled by MiniTruckin’ or by third-party printers, mailing houses, fulfillment providers, distributors, or other service providers acting on our behalf.
Estimated delivery dates are provided as a convenience only and are not guaranteed.
Delivery schedules may be affected by printing schedules, production delays, postal service interruptions, carrier delays, customs processing, weather events, labor disputes, governmental actions, or other circumstances beyond our reasonable control.
Delivery Address
Subscribers are responsible for maintaining an accurate and current mailing address.
Address changes should be submitted as soon as possible. Because magazine mailing lists are prepared in advance of publication, address changes may not take effect immediately and may not apply to issues already in production or mailing.
MiniTruckin’ is not responsible for issues delivered to an outdated or incorrect address provided by the subscriber.
Missing or Damaged Issues
If you do not receive an issue or receive a damaged issue, please contact MiniTruckin’ within 7 days after the expected delivery date.
MiniTruckin’ may, in its reasonable discretion and subject to availability, replace the issue, extend the subscription term, provide store credit, or offer another appropriate remedy.
Replacement copies are subject to inventory availability and are not guaranteed.
Subscription Changes
MiniTruckin’ reserves the right to modify:
- publication schedules;
- issue frequency;
- cover designs;
- editorial content;
- subscription pricing;
- promotional offers;
- digital features; and
- subscription benefits.
These changes do not constitute a breach of these Terms.
Automatic Renewal
If a subscription is offered on an automatically renewing basis, the applicable renewal terms, billing frequency, cancellation procedures, and any required disclosures will be presented at the time of purchase.
Unless otherwise stated at the time of purchase, subscriptions do not automatically renew.
Cancellation
Subscribers may cancel future subscription renewals at any time.
Cancellation does not entitle the subscriber to a refund for issues already shipped, printed, processed, or fulfilled, except where required by applicable law.
Publisher Discretion
MiniTruckin’ reserves the right to suspend, discontinue, delay, or modify any publication, subscription offering, or related Service at any time.
If a publication is permanently discontinued before the end of a prepaid subscription term, MiniTruckin’ may, in its reasonable discretion and subject to applicable law, provide a prorated refund, substitute publication, store credit, or another comparable remedy.
